Market Wire - Eisai Commences U.S. Legal Action Over Aricept ODT(R) ANDA Filing
Eisai Co., Ltd. (Headquarters: Tokyo,
President and CEO: Haruo Naito) and Eisai Inc. (Headquarters: New Jersey,
Chairman and CEO: Hajime Shimizu) today announce that they have filed a
lawsuit against Mutual Pharmaceutical Co., Ltd. and United Research
Laboratories, Inc. regarding its submission of an abbreviated new drug
application (ANDA) to the FDA for Aricept ODT Orally Disintegrating
Tablets (Active Ingredient Name: donepezil hydrochloride). Eisai’s action
was filed in the U.S. District Court for the District of New Jersey in
Newark on August 3, 2006.
Eisai believes that its donepezil composition patent is valid until its
expiration date of November 25, 2010. Eisai intends to vigorously enforce
and defend that patent.

Aricept is an acetylcholinesterase inhibitor and is believed to work by
